Radley IP Holdings, LLC is the controller of your personal information for the purposes of applicable data protection laws.

Some of those third parties, including our licensees and franchisees, may be controllers of your personal information in their own right. What personal information we have about you, and how we collect your personal information

The personal information we collect

We collect and/or hold information about you if you have purchased a Radley product (either on our website or a website operated by one of our licensees or franchisees), or if you have opted in to receiving Radley marketing communications, including via our website or a website of our licensees or franchisees.

We collect and/or hold the following personal information about you:

·                  Your purchase history (information about the Radley products you have purchased)

·                  Information about how you use our website and other technical data, including the nature of your device, browser type and version, time zone setting and location, your IP address, operating system and platform, device ID and other technology on the devices you use to access this our website.

We may subsequently contact you to ask for your opinions on our products and brands, check whether you would like to take part in relevant competitions or sweepstakes, or create a profile setting out your preferences for our brands and/or products. We also collect, use and share aggregated data such as statistical or demographic data which is not your personal information as it does not directly (or indirectly) reveal your identity. How we share your personal information

Who we share your personal information with

When you opt-in to receive communications from us or otherwise choose to take part in the activities described in this Notice we may share your personal information with various of our partners, service providers, and regulators in the manner and for the purposes described below:

·                  with our subsidiary, Radley IP Services Limited, who will host your personal data on our behalf;

·                  with other members of our corporate group for internal administration purposes;

·                  with third parties who help manage our business and deliver services. These third parties have agreed to confidentiality restrictions and use any personal information we share with them or which they collect on our behalf solely for the purpose of providing the contracted service to us. These include marketing services providers who may send marketing communications on our behalf, organisations who carry out market research or surveys on our behalf and vendors who help manage our IT and back-office systems;

·                  with our regulators, which may include the Information Commissioner's Office (ICO), to comply with all applicable laws, regulations and rules, and requests of law enforcement, regulatory and other governmental agencies;

As referred to above, we appoint licensees and franchisees to support the Radley brand and the sale of Radley products. In most cases these licensees and franchisees will act as data controllers in their own right wherever they handle your personal information, which means that they will be responsible (rather than us) for how they handle that information. You should review the privacy notices and policies that they make available to you in order to understand how they will use your personal information.

International transfers of your personal information

While we will ensure that your personal information is primarily hosted within the United Kingdom, we are a US business and so there are circumstances in which your personal information will be processed within or transferred to the United States. Your personal information may also be transferred to those of our partners and service providers who are based outside of the UK and the European Economic Area (EEA).

How we protect and store your information

We have implemented and maintain appropriate technical and organisational security measures, policies and procedures designed to reduce the risk of accidental destruction or loss, or the unauthorised disclosure or access to such information appropriate to the nature of the information concerned. Measures we take include placing confidentiality requirements on our staff members and service providers and destroying or permanently anonymising personal information if it is no longer needed for the purposes for which it was collected.

Storing your personal information

We will store your personal information for as long as is reasonably necessary for the purposes for which it was collected, as explained in this Notice. Right to access personal information

We are not required to comply with your request to erase personal information if the processing of your personal information is necessary:

·                  for the establishment, exercise or defence of legal claims.

Right to restrict the processing of your personal information

You can ask us to restrict your personal information, but only where:

·                  its accuracy is contested, to allow us to verify its accuracy; or

·                  the processing is unlawful, but you do not want it erased; or

·                  it is no longer needed for the purposes for which it was collected, but we still need it to establish, exercise or defend legal claims; or

·                  you have exercised the right to object, and verification of overriding grounds is pending.

We can continue to use your personal information following a request for restriction where:

·                  we have your consent; or

·                  to establish, exercise or defend legal claims; or

·                  to protect the rights of another natural or legal person.

Right to transfer your personal information

You can ask us to provide your personal information to you in a structured, commonly used, machine-readable format, or you can ask to have it transferred directly to another data controller, but in each case only where:

·                  the processing is based on your consent or on the performance of a contract with you; and

·                  the processing is carried out by automated means.

Right to object to the processing of your personal information

You can object to any processing of your personal information which has our legitimate interests as its legal basis, if you believe your fundamental rights and freedoms outweigh our legitimate interests.

If you raise an objection, we have an opportunity to demonstrate that we have compelling legitimate interests which override your rights and freedoms.

Right to object to how we use your personal information for direct marketing purposes

You can request that we change the manner in which we contact you for marketing purposes.

Right to lodge a complaint with us or your local supervisory authority

You have a right to lodge a complaint with us and/or with the Information Commissioner's Office in the UK (www.ico.org.uk) if you have concerns about how we are processing your personal information. The ICO will expect you to have tried to resolve any complaint that you have directly with us before contacting them, so please do make sure that you have made your complaint to us or sought clarification from us before contacting the ICO.

We may ask you for additional information to confirm your identity and for security purposes, before disclosing the personal information requested to you in response to any request raised by you. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive.

Subject to legal and other permissible considerations, we will make every reasonable effort to honour your request promptly or inform you if we require further information to fulfil your request.
